Terms of Service
1. Acceptance of Terms
By accessing or using YOUGC, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform.
2. Services
YOUGC is a marketplace that connects brands in Mauritius with local creators to produce user-generated content (UGC) videos. We provide the tools for posting campaigns, negotiating rates, messaging, and processing payments.
3. User Accounts
You must provide accurate information when creating an account. Creators must complete a portfolio with at least 2 videos and 3 photos before their profile is validated. You are responsible for all activity under your account.
4. Rates, Payments & Commission
Creators set their own rate per video. Brands may accept, decline, or counter-offer. When a brand accepts an offer, the brand is charged the agreed rate multiplied by the number of videos plus a 20% platform commission. The first collaboration for every brand is free of commission. Creators keep 100% of their agreed rate.
5. Content & Delivery
Creators have 7 days to deliver content after an offer is accepted, unless otherwise agreed in writing through the app messaging system. All content must comply with the brand brief and applicable laws. Brands may request reasonable revisions.
6. Intellectual Property
Upon full payment, the brand receives a license to use the delivered content for the purposes described in the campaign brief, unless the parties agree otherwise. Creators retain ownership of their original work unless a work-for-hire agreement is explicitly stated.
7. Prohibited Conduct
Users may not post illegal, misleading, hateful, or infringing content; harass other users; manipulate ratings or reviews; or attempt to circumvent platform fees or payment systems.
8. Termination
We may suspend or terminate accounts that violate these terms or harm the platform community. Users may delete their account at any time by contacting support.
9. Limitation of Liability
YOUGC is provided "as is". We are not liable for disputes between creators and brands, content performance, or indirect damages. Our liability is limited to the amount of commission we earned on the transaction in question.
10. Governing Law
These terms are governed by the laws of the Republic of Mauritius. Any disputes will be resolved in the courts of Mauritius.
11. Changes to These Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
